DMCA Policy | Zenfied's Zero-File Storage Compliance

This DMCA Policy outlines the procedures Zenfied.com follows regarding copyright infringement claims under the Digital Millennium Copyright Act ("DMCA").

Zenfied.com respects the intellectual property rights of others and expects its users to do the same. This policy details how to report alleged copyright infringement and how we will respond, taking into account our unique client-side processing model.

By using Zenfied.com, you acknowledge and agree to this DMCA Policy.


1. What is the DMCA?

The DMCA is a US law that helps copyright owners report online infringement and provides a framework for service providers to address it.

The Digital Millennium Copyright Act (DMCA) is a United States copyright law that provides a legal framework for addressing copyright infringement online. It offers copyright owners a mechanism to request the removal of infringing material from websites and online services (known as "Notice and Takedown"), and it provides "safe harbors" for online service providers who comply with its requirements.


2. Zenfied.com's Client-Side Processing and the DMCA

Our tools process files directly in your browser. We never upload or store user files, which significantly impacts how we can handle copyright infringement related to them.

It is critical to understand the fundamental operational model of Zenfied.com's Services:

  • Client-Side Processing: All file conversions, compressions, merging, and other tool functionalities happen directly on your computer, within your web browser.
  • No File Uploads or Storage: Your files are never sent to our servers or any third-party servers for processing by our tools, and consequently, we do not store them.
  • No Access to Content: Zenfied.com has no access to the content of the files you process using our tools.

Because we do not host, store, or have access to user-processed files, traditional "takedown" procedures for infringing *user-generated content* (e.g., a copyrighted file uploaded by a user) are not applicable to the files processed through our tools. We cannot "remove" files from our servers that were never on our servers.

However, we are committed to upholding copyright law. Our DMCA procedures primarily address:

  • Copyright infringement related to Zenfied.com's *own content* (e.g., text, images, code directly displayed on our website, not part of a client-side tool's operation).
  • Instances where a user might be systematically misusing our Services in a way that directly facilitates infringement, as determined by us.

3. Reporting Copyright Infringement (DMCA Notice)

If you believe your copyright has been infringed by Zenfied.com's website content or via systematic misuse of our tools, please send a formal DMCA notice to our Designated Agent.

If you are a copyright owner or an agent thereof and believe that any content or material on Zenfied.com (excluding user-processed files which are client-side) infringes upon your copyrights, you may submit a written DMCA notice to our Designated Copyright Agent with the following information:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material. (For Zenfied.com, this would relate to content directly on our web pages, or specific tool functionality, not user-processed files).
  4. Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.


4. Our Response to a Valid DMCA Notice

Upon receiving a valid notice, we will promptly investigate. Actions may include removing infringing site content or, in severe cases of misuse, restricting access to our tools.

Upon receipt of a valid and complete DMCA Notice, Zenfied.com will:

  • Promptly investigate the claim.
  • If the claim relates to content directly hosted by Zenfied.com (e.g., text, images, code on our web pages, banners, or design elements that are part of our site's static assets) and is found to be infringing, we will take reasonable steps to remove or disable access to that material.
  • If the claim alleges that a *tool* itself (or its core functionality as provided by Zenfied.com) infringes copyright, we will review the claim and, if appropriate, take steps to modify or disable the tool.
  • For claims related to user misuse of our client-side tools (e.g., a user processing copyrighted material and then distributing it elsewhere), our direct ability to "take down" the infringing *file* is limited as we do not host it. However, we will document the complaint and take appropriate action if there is a pattern of identified systematic misuse directly linked to our Service that falls within our control.

We reserve the right to remove content or disable access at our sole discretion.


5. Counter-Notification

If your content (on Zenfied.com's site) was removed due to a DMCA notice, you can submit a counter-notice if you believe it was a mistake.

If you believe that your content (referring to Zenfied.com's direct site content that may have been removed or disabled due to a DMCA notice) was removed or disabled by mistake or misidentification, you may send a counter-notification to our Designated Copyright Agent. Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which Zenfied.com may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, we will send a copy to the original complaining party. Unless the copyright owner files an action seeking a court order against you within 10-14 business days, we may replace the removed material or cease disabling access to it.


6. Repeat Infringers

Users who repeatedly infringe copyright may have their access to Zenfied.com's services terminated.

In accordance with the DMCA and other applicable law, Zenfied.com has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers of copyright.

While we do not store user files, if a user is found to be consistently and systematically misusing our Services in a manner that facilitates copyright infringement (e.g., repeatedly providing links to infringing material, or using tools to create and distribute infringing content externally, with clear evidence), we reserve the right to suspend or terminate their access to Zenfied.com.


7. Designated Copyright Agent

All DMCA notices and counter-notices should be sent to our designated email address.

All notifications of claimed copyright infringement or counter-notifications must be sent to Zenfied.com's Designated Copyright Agent via email at:

8. Changes to This DMCA Policy

We may update this policy. Changes will be posted here with an updated "Last Updated" date.

We reserve the right to update or change this DMCA Policy at any time. Any changes will be effective immediately upon posting the revised policy on this page, with an updated "Last Updated" date at the top. We encourage you to review this policy periodically for any changes.
